This contest is subject to the following terms and conditions (“T&C”), which can be changed by Orion Nutritionals Private Limited (“Orion”) from time to time without notice to Contestant (as defined below). If the Contestant does not agree with these T&C, Contestant is advised not to participate in the Contest (defined below). Participation by submission of entry as per the T&C below shall be deemed acceptance of such T&C by the Contestant.

1. Definitions:

(a)  “Contest” means the contest being launched by Orion through print advertisements (“Print Ad”) in newspapers across India;

(b)  “Contestant” means a participant who is eligible and chooses to participate in the Contest;

(c)  “Judge” means Orion which shall exercise its sole discretion and have final authority to declare the Winner of the Contest. Orion’s decision shall be final and binding on the Contestant;

(d)  “Prize” means and includes a four-day trip to Seoul for one person which is inclusive of flight ticket and a three-night stay in a three-star hotel in Seoul (“Tour Package”). The Prize will be given to the Winner of the Contest by Orion; and

(e)   “Winner” means the Contestant declared as winner by Orion.  

2. Eligibility:

This Contest is valid for Indian citizens entitled to enter into any contract and are aged eighteen (18) years and above. However, Contestants below eighteen (18) years of age may participate in the Contest through their parents or guardian.

3. Contest Duration:

Contest is scheduled to start from May 12, 2023 and shall continue till June 20, 2023.

4. Participation Fee:

There is no fee for participation in the Contest.  

5. Contest, its features and procedure to participate in the Contest:

(a)   In order to participate in the Contest, Contestants have to:

• scan the QR code given in the print ad which will take the Contestants to Orion’s web-page (https://ipl.orionindia.com/);
• answer the question mentioned on the web-page;
• submit the answer by clicking on the ‘next’ tab;
• enter his/her details such as name, city, email address, contact details etc.; and
• follow Orion’s Instagram page i.e., @orionsnacks, mentioned on the web-page.

(b)   A Contestant’s participation will be valid only if they have a valid and verified email id.

(c)  Answers once submitted by the Contestants on the webpage cannot be changed or updated.

(d)  Contestant understands that mere participation in the Contest does not entitle the Contestant to win the Prize.

(e)  The Winner will be selected at Orion’s discretion based on the answers received from May 12, 2023 till June 20, 2023 subject to following the procedure mentioned in clause (a) above.

(f)   The result will be announced by Orion on its Instagram page (@orionsnacks) at the end of June, 2023 and the same will be final and no correspondence in this regard will be entertained.

(g)  The details of the Prize i.e., Tour Package will be sent to the Winner through an email. The Winner will be contacted after the Contest is over.

6. Prizes:

(a)  Contestants will be eligible to win the Prize only in case they have duly followed the procedure mentioned in clause 5 (a) above.

(b)  For verification purposes, Orion may ask the Winner of the Tour Package to produce the following documents:

• Proof of Identity with photo
• Proof of age
• Proof of Address
• Copy of PAN card; and
• Any other document as required by Orion.

(c)  The Prize shall be non-transferable.

(d)  No Cash payment in lieu of the Prize shall be made.

(e)  All applicable taxes/duties/levies including service tax or applicable gift taxes on winning the Prize shall be borne by the Winner.

(f) The Prize shall be subject to T&C and compliance with all applicable statutory legislations/processes/formalities as may be applicable to the Prize.

7. Other Terms:

(a)  The following are the inclusions and exclusions of the Tour Package:

      Inclusions

• Economy-class round trip airfare (Delhi- Seoul- Delhi) on low-cost airlines, without meal; and
• 3 Nights/4 Days’ accommodation in a three-star hotel in Seoul.

Exclusions

• On arrival visa fee (to be Paid directly by the Guest) or visa fee from India of INR 2800 extra;
• Return airport transfers and sightseeing tours;
• Airport taxes;
• All hotel taxes and service charges levied by hotel;
• Any services not mentioned in the inclusions;
• Travel insurance;
• Any expenses of personal nature such as tip to drivers/guides/hotel representatives, porterage charges, laundry charges, wines, mineral water, all meals and drinks;
• Surcharges, if any, applicable due to peak season; and
• All taxes levied by Government of India such as applicable Goods and Service Tax and Tax Collected at Source.
• Standard check-in time at the hotels in Seoul is normally 2 pm and check-out is 12 noon (Korean standard time) . An early check-in, or a late check-out is solely based on the discretion of the hotel.
• Entrance fee, parking and guide charges at sight-seeing spots are not included in the Tour Package.
• Airline seats and hotel rooms are subject to availability at the time of booking.
• Any changes made directly by the hotel come under their direct purview and Orion will not be liable for any compensation due to this change.
• The Winner will be subject to airline restrictions/limitations on baggage weight/size/number from time to time. Traditionally, each airline allows their customers to bring one carry-on bag and one personal item, such as a pocket-book, backpack or laptop bag. The dimensions of which should not exceed 115 linear cms and weight should not exceed 7 kgs. General airline restriction for check-in baggage is 20 kgs for economy class.
• Orion shall, in no circumstances whatsoever be liable to the Winner for loss of baggage by the airline, failure on the part of airline to accommodate the Winner despite having confirmed tickets, flight delay, if the Winner misses the flight, change in flight schedule/airline mentioned at the time of booking.
• Orion, reserves the right to change/modify the terms and conditions of the Tour Package at any point, due to reasons including but not limited to wars, civil or political disturbances, natural calamities like landslides, floods, earthquakes, other extreme weather conditions lockdowns, epidemics, quarantine, embargoes, lockouts, industrial dispute, strikes, explosions or terrorist action, blockade, revolution, emergency proclamation, rebellion, insurrection or nuclear blast riots, directions, acts or orders of government imposing restrictions, change in law/policies (each termed as a “Force Majeure Event”), traffic problems, fairs, festivals, overbooking of hotels/flights, cancellation/re-routing of flights, closure of/entry restrictions at a place of visit or any other act or condition beyond the reasonable control of Orion.  While Orion will make best efforts to make suitable alternate arrangements, Orion would not be held liable for any refunds/compensation claims arising due to occurrence of aforesaid events.
• Hotel may ask for a security deposit during check-in, which will be refundable at check-out subject to the hotel policy. This needs to be paid by Winner.
• Cost of deviation and cost of extension of the validity on your ticket is not included and Winner has to bear the cost of the same.
• Orion reserves the right to disqualify any Contestant if it has reasonable grounds to believe the Contestant has breached any of these T&C. In case of any failure on the part of the Winner to comply with directions issued by Orion, Orion, in its own discretion, shall be entitled to cancel the Prize for the said Winner. No correspondence in this regard shall be entertained. Orion’s decision shall be final, binding and non-contestable.
• Orion’s responsibility in the present offer is limited to sending the details of the Tour Package to the Winner on their e-mail id. The Winner hereby agree that Orion is not responsible for the acts and omission relating to the Tour Package.
• Any dispute/complaint regarding the Tour Package must be addressed by the Winner in writing to the concerned travel agency mentioned in the documents related to the Tour Package directly, and Orion shall not entertain any communication in this regard.
• The Winner of the Tour Package agrees to unconditionally abide, adhere and comply solely at his/her costs and expenses  to all laws, rules, notifications, travel advisories, guidelines, directives, and communications issued from time to time by all or any Governments, Authorities, Ministries, Departments, Local Bodies in India or Seoul , related to his/her tour to Seoul on reaching the travel destination and on his/her return from the tour to his/her home destination in India including but not limited to Covid-19 Protocols on quarantine, vaccinations, etc. or in connection with any other pandemic, epidemic, disease, condition, etc., which may be communicated by all or any Governments, Authorities, Ministries, Departments, Local Bodies in India or Seoul with or without notice at any point of time whether at the commencement of the tour, during the tour and/or on the completion of the tour, as the case may be.
• This Contest cannot be combined with any other offer or promotion currently being offered by Orion.
• One Contestant would be eligible for one reward only.
• Subject to applicable laws, Contestant hereby grants Orion by participating in the Contest and/or accepting a Prize, the right to use, the Contestant’s information, publish and display Contestant’s picture which may be adapted, edited or modified, as solely determined by Orion for advertising, trade, publicity and promotional purposes in any media.
• If for any reason the Contest cannot be held as planned, including without limitation any infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, or for any other reason whatsoever, Orion reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest.
• Orion reserves the right at any time without prior notice to add, alter, modify, all or any of these T&C including the eligibility criteria, dates of Tour Package, etc., or replace, wholly or in part, this Contest’s rules and gratifications, if any, or withdraw this Contest altogether. Therefore, Contestants are advised to regularly check for any amendment(s) or update(s) to the T&C. No correspondence in this regard shall be entertained.
• The Contestant expressly agrees and acknowledges that the Contestant participates in the Contest at his/her sole risk and responsibility and that the Contest is being offered on an “AS IS” and “AS AVAILABLE” basis. Orion expressly disclaims all warranties of any kind, whether express or implied.
• Neither does Orion make any warranty that the Contest and or emanating results will meet the Contestants’ expectations, or the Contest will be conducted without interruptions, in a timely and secure manner.
• Orion will in no event be liable for any damages whether direct, indirect, special, incidental, or consequential arising out of the Contest or use of the Prize given through the Contest.
• The Contestant hereby agrees and undertakes not to hold Orion and/or or any of its group entities or affiliates, its respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses that the Contestant may/might have suffered, sustained or incurred, or claims to suffer, sustain or incur, by way of and/or on account of participation in the competition.

In the event of any conflict between the T&C herein, and any other information displayed on our Instagram page (@orionsnacks) and the web-page, the T&C herein shall prevail.
